ProFekt™ Product Warranty

15-Year Limited Warranty

United Plastics Corporation warrants its ProFekt™ products to be free from rot, decay, split, check, splinter, or termite damage as a direct result of defects caused by manufacturing, materials and workmanship for a period of 15 years from the date of original purchase. This is a non-transferrable warranty.

Each purchaser of a ProFekt™ product is solely responsible for determining the effectiveness, suitability and safety of any particular use or application of the product. Building code regulations vary from area to area. Each ProFekt™ purchaser should consult local building and safety codes for specific requirements in connection with a residential structure and its installation in accordance with manufactures written guidelines.

United Plastics Corporation shall have no liability for defects or damage caused by improper installation, installation on unapproved surfaces, extractive bleeding, mold or mildew growth, water rings, food, organic, pet or paint stains, settlement, shrinkage or distortion of the substructure, nonapproved surface treatments applied to the ProFekt™ surface, stains from galvanized or uncoated fasteners, improper handling, storage, abuse or neglect by purchaser or third party and variations or changes in color of ProFekt™ as all colors may fade.

United Plastics Corporation liability under this warranty is limited solely and exclusively to the replacement of the defective ProFekt™ product and in no event shall be liable for labor, installation, reinstallation, freight, taxes or any other charge related to defective product. United Plastics Corporation shall not be liable for any indirect, incidental, punitive, consequential, exemplary or other damages of any kind whatsoever, whether any such claim is based upon theories of contract , warranty, negligence, tort, strict liability or otherwise. In any dispute of product performance the purchaser shall bear the burden of proof that the product was installed, finished and maintained in accordance with the manufacturer’s instructions.

To file a claim under this warranty, the original purchaser must send proof of purchase, a picture of the defective product and a written description of the issue in question to United Plastics Corporation, 511 Hay Street, Mount Airy, NC 27030. United Plastics Corporation reserves the right to investigate any claim and inspect the installation upon notification of claim. All claims must be made within 30 days. Upon verification of a claim, United Plastics Corporation shall arrange for the delivery of the replacement product.

No dealer, person or entity is authorized by United Plastics Corporation to make statements or representations regarding the performance of ProFekt™ product except as contained in this warranty and United Plastics Corporation shall not be bound by any such statements other than those contained within.

TO THE EXTENT PERMITTED BY LAW, THE WARRANTY SET FORTH HEREIN IS EXCLUSIVE, AND IN LIEU OF AND EXCLUDING ALL OTHER WARRANTIES OF UNITED PLASTICS CORPORATION, ITS AGENTS OR EMPLOYEES, WHETHER EXPRESSED OR IMPLIEDINCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MECAHANTABILITY, FITNESS FOR USE AND NON-INFRINGEMENT. EXCEPT TO THE EXTENT SPECIFICALLY PRECLUDED BY APPLICABLE LAW, AND DOES NOT INCLUDE ANY LIABILITY FOR CONSEQUENTIAL , INCIDENTIAL, SPECIAL OR ANY OTHER DAMAGES OF ANY KIND WHATSOEVER, WHETHER THE CLAIM IS BASED UPON THEORIES OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE. SOME STATES DO NOT ALLOW LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO EVERYONE. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS THAT WILL VARY FROM STATE TO STATE.
